The Unified Patent Court becomes a reality today, 1 June 2023 Practical information on the upcoming launch of the CMS Entry Into Force (EIF) as of 1st of June On the 1st of June, the Unified Patent Court is set to start the Entry Into Force version of the CMS. This communication aims at providing detailed information regarding the actions that the UPC will perform before the 1st of June in order to prepare and secure the CMS version of Entry Into Force. Practical information on how to correct SPC data In the how-to-guide herein included, the UPC informs users on the current workflow regarding corrections of supplementary protection certificates’ (SPC) data. Please note we are working on optimizing this workflow. The Court will communicate on such improvement in due course UPC informs about the eligibility of lodging opt-out applications in hard copy form A party may lodge a document in hard copy for the reason that the electronic case management system (CMS) has ceased to function (Rule 4.2 UPC Rules of Procedure) only after the Court has established such a situation. This is currently not at hand. If the Court, however, will establish such a situation due to an overstressing of the system or any other reason during the remaining last days of the sunrise period, users who wish to lodge an application for an opt-out by hard copy are advised to follow a specific process described in this communication. Activation of measure to preserve the CMS performance In view of the approaching end of the Sunrise period, we are striving to ensure that all those who want to file opt-outs can do so, and this still within the Sunrise period. COMMUNICATION – OATH TAKING OF THE JUDGES OF THE UNIFIED PATENT COURT Communication on the oath taking of the judges of the Unified Patent Court (EN, FR, DE) Decision on the provisional distribution of actions related to patents in IPC sections (A) and (C) pending before the central division In its meeting of 8 May 2023, the Presidium of the Unified Patent Court decided that, as from 1 June 2023, actions pending before the central division related to patents in IPC section (A) shall be assigned to the seat in Paris while actions related to patents in IPC section (C) shall be assigned to the section in Munich. The resulting acceleration of the pace of opt-outs being filed during these last weeks means that the CMS is now under considerable pressure.
