Application Decision

La JUB a compétence lorsque le défendeur est domicilié sur un Etat membre contractant, pour connaitre d'une action en contrefaçon d'un brevet européen, désignant le territoire des Etats de l'Union européenne non-membres de l'AJUB et le territoire des Etats liés par la Convention de Lugano, lorsque la validité du brevet est contestée par voie d’exception, la JUB ayant la faculté de suspendre l'examen de la contrefaçon, lorsqu'il existe des chances raisonnables non négligeables que le brevet soit annulé par la juridiction de l'Etat membre de délivrance.   La JUB saisie d'une action en contrefaçon d'un brevet européen désignant le territoire d'un Etat tiers, a compétence, lorsque le défendeur est domicilié sur son territoire, pour statuer sur la question soulevée par voie d'exception de la validité de ce brevet, la décision à cet égard n'ayant qu'un effet inter partes.

The UPC has jurisdiction when the defendant is domiciled in a UPCA Contracting Member State, to hear an infringement action regarding a European patent, designating the territory of the States of the European Union which are not Contracting Members States of the UPCA and the territory of the States bound by the Lugano Convention, when the validity of the patent is challenged by way of a plea, the UPC having the power to suspend the examination of the infringement, where there is a reasonable non-negligible possibility that the patent would be declared invalid by the court of the Member State of the grant.
