Application Order

1. Der Berichterstatter hat den Grundsatz der Verfahrensökonomie nicht nur in Bezug auf die Parteien, sondern als Stellvertreter auch für den Spruchkörper insgesamt im Blick zu behalten. 2. Die Verfahrensökonomie gebietet es regelmäßig nicht, im Rahmen einer Vorabentscheidung durch den Spruchkörper nach Regel 334 lit. h) VerfO über die materielle Zulässigkeit von Klageänderungsanträgen (R. 263 VerfO) zu entscheiden, die auf Anträgen auf Änderung des Patents (R. 30 VerfO) beruhen. 3. Materielle Entscheidungen von dieser Tragweite sind regelmäßig dem Hauptverfahren, namentlich der mündlichen Verhandlung, insbesondere der Endentscheidung durch den Spruchkörper zu überlassen.

1. The Judge-Rapporteur must bear in mind the principle of procedural economy not only in relation to the parties but also, as deputy, for the formation of the Court as a whole. 2. Procedural economy does not normally require the panel to decide on the substantive admissibility of requests to amend the application (Rule 263 of the Rules of Procedure) based on requests to amend the patent (Rule 30 of the Rules of Procedure) in the context of a preliminary ruling by the panel pursuant to Rule 334(h) of the Rules of Procedure. 3. Substantive decisions of this scope must normally be left to the main proceedings, namely the oral proceedings, in particular the final decision by the panel.
