Application Order

1. En vertu de R. 263 RdP, une partie ne peut être autorisée, par la Cour, à modifier ses prétentions, qu’à la double condition que la modification n’ait pu être formée avec diligence, à un stade antérieur de la procédure et qu’elle ne soit pas de nature à perturber de manière déraisonnable, la conduite de l’affaire. 2. L’autorisation donnée par la Cour, au visa de la règle R. 263 RdP, ne concerne que les demandes modifiées qui ont pour effet de modifier l’objet et le périmètre du litige. 3. Les prétentions modifiées qui ne font que compléter celles précédemment sollicitées ne constituent pas des modifications substantielles, qui sont de nature à modifier et à porter atteinte à l’objet du litige et à son périmètre et ne portent que sur les modalités de mise en œuvre et d’exécution d’une éventuelle condamnation.

1. Pursuant R. 263 RoP, a party may only be authorized, by the Court, to change its claims, on the twofold condition that the amendment could not have been made with reasonable diligence at an earlier stage of the proceedings and that it is not such as to disturb in an unreasonable way the conduct of the case. 2. The autorisation given by the Court, under rule R. 263 RdP, only concerns changed claims which have the effect of changing the subject matter and the scope of the dispute. 3. Changed claims that only complete those previously made do not constitute substantial modifications, which are likely to modify and affect the subject matter and the scope of the dispute and only relate to the implementation and enforcement modalities of a possible sentence.
